YOU AND DEWEY'S PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a class or representative proceeding.
12.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek emergency injunctive relief or other equitable remedies from a court of competent jurisdiction to protect intellectual property rights or confidential information pending the outcome of arbitration.
13. Term and Termination
These Terms shall remain in full force and effect while you use the Site and services. We reserve the right, in our sole discretion, to:
- Terminate or suspend your access to all or part of the Site and services at any time, with or without cause, and with or without notice.
- Cancel any pending or future orders associated with your account.
